Lumencity (“Company”, “we”, “us” and “our”) respects the privacy of every user accessing its website at www.lumencity.in (“Website”). For the purposes of this privacy policy (“Privacy Policy”), “you”, “your” and “user” mean any natural or legal person who accesses or uses the Website; where a natural person represents a business entity, these terms include that business entity.

We have adopted this Privacy Policy in compliance with applicable laws to inform you of what information we collect through the Website, how we collect it, how we may use it, and the steps we take to protect it. Specifically, it covers:

  • The purpose for which that data is collected

Capitalised terms used but not defined here have the meanings assigned to them under the Information Technology Act, 2000 (“IT Act”) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“SPDI Rules”). References to Personal Information include Sensitive Personal Data or Information (“SPDI”) wherever appropriate or mandated under the IT Act and SPDI Rules.

2Information We Collect

The information you provide to us, or that we collect from you, may consist of Personal Information and Non-Personal Information.

Personal Information

Personal Information includes, but is not limited to:

  • Your name, username and password
  • Your address, telephone number, email address and other contact information
  • Your date of birth and gender
  • Information regarding your transactions on the Website, including purchase history
  • Financial information such as bank account, credit/debit card or other payment instrument details, including one-time passwords
  • Your internet protocol (IP) address and the identification code of the device you use to access the Website
  • Any other information you provide during registration or while using the Website

We are not responsible for any transmission you receive from a third-party website, and we make no representations about their privacy practices. We may also disclose Personal Information to law enforcement offices, third-party rights owners, or others in the good-faith belief that such disclosure is reasonably necessary to enforce our terms or this Privacy Policy, respond to claims that content violates the rights of a third party, or protect the rights, property or personal safety of our users or the general public.

Change in Business Constitution

Should we plan to merge with or be acquired by another business entity, or undergo reorganisation, amalgamation or restructuring, we may disclose or transfer some or all of your Personal Information to that entity. In such an event, the other entity (or the new combined entity) will be required to follow this Privacy Policy with respect to your Personal Information.

6Security Practices & Procedures

The security of your information is very important to us. We use reasonable security measures — at minimum, those mandated under applicable laws — to safeguard and protect your information. You accept the inherent security implications of sharing information online and agree not to hold us responsible for a breach of security or disclosure of information unless we have been grossly and wilfully negligent.

We may enter into agreements with third parties (in or outside India) to store your information. These third parties may have their own security standards, and we will, on a commercially reasonable basis, require them to adopt reasonable security standards to safeguard your data.

Notwithstanding anything in this Privacy Policy, we shall not be held responsible for any loss, damage or misuse of your information attributable to a Force Majeure Event — any event beyond our reasonable control, including without limitation sabotage, fire, flood, explosion, acts of God, civil commotion, strikes, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage devices, computer crashes, and breaches of security and encryption.

In the event of any breach of your Personal Information, we will notify you by email without unreasonable delay and take appropriate measures in compliance with applicable laws.

7Your Rights & Choices

All Personal Information you provide to us is provided voluntarily. You have the right to withdraw your consent at any time by writing to us at info@lumencity.in. Withdrawal of consent applies prospectively, not retrospectively. If you do not provide Personal Information or consent for its use, or subsequently withdraw consent, we reserve the right to discontinue the services for which that information was sought.

You can review, modify, add, correct or update your Personal Information at any time. When you update information, we keep a copy of the prior version for our records. We are not responsible for the authenticity of the Personal Information you provide.

You acknowledge that certain data cannot be corrected or deleted, or is prohibited from being deleted, where required under applicable law, law enforcement requests or judicial proceedings — in respect of such data, the above rights will not be available.

Marketing opt-out: if you prefer not to receive direct marketing communications from us, simply click the unsubscribe link attached to any of our emails.

A word of caution: please be careful about sharing your personal information with any third party claiming to be related to Lumencity over separate emails or phone calls. We will never ask for your passwords or OTPs. We disclaim all liability for claims arising from information shared due to your own negligence or wilful misconduct with such third parties.

8Changes to This Policy

This Privacy Policy may be amended or updated from time to time. When we do so, we will update the “Last updated” date at the top of this page. We suggest you check this page periodically. Your continued use of the Website, or provision of data thereafter, implies your unconditional acceptance of such updates.

You acknowledge that this Privacy Policy is clear and easily accessible; states our policies and practices with respect to your information; describes the types of personal and sensitive personal data collected; explains the purposes of collection and usage; provides for disclosure of information; and provides for reasonable security practices and procedures.
